US Court Mandates Release of Kilmar Abrego Garcia from ICE Custody
A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment is without lawful basis.
"Since his release after erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her ruling.
The situation originates in a erroneous deportation to El Salvador earlier this year, which US authorities later acknowledged was an mistake. After his repatriation to the United States to answer human smuggling allegations, he was detained in federal detention.
In her decision, the court pointed out that the authorities does not have a current deportation order, which prevents them from removing Mr. Abrego Garcia "at this time."
