The ex-lawyer for the former president has resigned as New Jersey's top federal prosecutor. This follows a court battle that challenged her legal standing to occupy the role.

Attorney General's Statement

The head of the Justice Department, Pam Bondi, accepted the prosecutor's departure on the start of the week. Bondi stated that the court's "flawed" ruling made it impossible for the official to effectively run her office.

"Do not interpret following the order as giving up," Habba stated. "This battle will now extend throughout America."

Legal Background

The departure comes a week after a judicial panel found that she had been acting without proper authority as the federal prosecutor. This judgment is could influence many criminal cases in the state.

The appellate judges declared that a temporary posting that skirted confirmation by the US Senate violated the federal law governing appointments.

Next Steps and Responses

Bondi said that Habba will stay on at the Department of Justice as a top consultant. They intend to pursue additional appeals of the ruling, with hopes of a reversal.

Writing online, Bondi wrote that the court "should not be able to countermand the President's choice of prosecutors responsible for executing the primary duty of the administration of enforcing the law."

The attorney general highlighted the prosecutor's work and noted that during her run, the Newark saw a one-fifth decrease in offenses. Additionally that the city of Camden experienced its first summer in half a century free from homicides.

Background and Previous Role

Habba, first joined Trump's personal legal team in 2021. She went on to defended her client in his hush-money trial in New York last year, leading to his guilty verdict on dozens of charges of financial record manipulation.

Before Habba took on the top New Jersey post, the former president had revealed he was naming her as his presidential counsellor in a potential future term, calling her as "unwavering in her loyalty" and a "tireless advocate for justice".
